Perjury– A person commits perjury when that person makes a false statement regarding a material matter while under oath and the person does not believe that the statement is true. When the person makes this false statement while under oath but not in an official proceeding, that person is guilty of a first-degree misdemeanor and may be punished by probation or imprisonment of up to 1 year and/or fines of up to $1,000.
When the person makes the false statement while under oath in an official proceeding, the person is guilty of a third-degree felony and may be punished by probation or imprisonment of up to 5 years and/or fines of up to $5,000.
A person may defend against the crime of perjury by admitting they made a false statement in the same continuing proceeding and so long as the false statement has not substantially affected the proceeding or the admission of the statement’s falsity is made before it is discovered.
