Assault and Battery are two different crimes in Florida, and are often confused with each other. An assault is when you threaten somebody and have the apparent ability to carry out that threat. A battery is when you touch or hit someone against their will. Under Florida law there are varying degrees of assaults and batteries, from second degree misdemeanors to life felonies, with potential consequences from county jail all the way to life in prison.
